Disputes Between Licensees
Companies in the utility marketplaces often purchase services from each other. For example, telecommunications operators who wish to provide services to end users normally have to buy some services from the incumbent operator – Cable & Wireless Guernsey – because the new operators do not have a full network reaching end users in the Bailiwick. Similarly, ISPs usually have to buy their telecoms capacity from a telecoms operator because they do not have a network of their own.
Many of the contracts for such services include dispute resolution procedures, for example Service Level Agreements for Private Circuits, or Agreements for Interconnection and Access based on the Reference Offer.
However, in the event of a disagreement or dispute between two or more licensees that has not been resolved under the contractual arrangements in place, the OUR dispute resolution procedures can be used and the OUR can intervene.
To submit a dispute for resolution, a request for dispute resolution form should be filled in according to the guidelines set out in OUR 02/32 (go to document OUR 02/32) and presented to the OUR either by email to director.general@regutil.gg or in writing to:
